§1 General provisions
- This Privacy Policy sets out the rules for processing personal data of Users of the WorldCam.Live portal, available at worldcam.live, hereinafter referred to as the “Portal”.
- The controller of personal data is GemsNet Mariusz Guć, with its registered office at: ul. Józefa Dwernickiego 8c/30, 85-675 Bydgoszcz, NIP: 5581728012, REGON: 093201358, hereinafter referred to as the “Controller”.
- The Controller may be contacted in matters concerning personal data protection by e-mail at: worldcam@worldcam.pl.
- The Controller processes personal data in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council, hereinafter referred to as the “GDPR”.
- The Controller applies technical and organisational measures intended to protect personal data, in particular access safeguards, transmission encryption using the SSL/TLS protocol, and limiting access to data solely to authorised persons.
- Data provided in the Portal forms are treated as confidential and are not visible to unauthorised persons.
§2 Scope of data processed
- The Controller may process personal data provided by the User during registration, login, use of the Account, contact forms, comments, reports, camera broadcaster services and paid services, if available.
- Depending on how the Portal is used, the Controller may process in particular:
- e-mail address,
- login or User name,
- IP address,
- technical data of the device, browser and operating system,
- data stored in server logs,
- content of comments, messages, reports and correspondence,
- data concerning activity in the Portal,
- data concerning Account configuration,
- data concerning cameras added by the User, including the camera name, description, location indicated by the User, stream address, image snapshots, camera status and technical connection data,
- billing data, if the User uses paid services, in particular first name and surname or company name, address, tax identification number, invoice data, payment history and information about the selected package.
- Server logs may store, in particular: IP address, connection date and time, URL address, referrer address, browser type, operating system, device type, information about errors, security events and other technical data necessary for the proper and secure operation of the Portal.
§3 Purposes and legal bases for data processing
- Personal data are processed for the purpose of creating, maintaining and servicing the User Account. The legal basis for processing is that processing is necessary for the performance of an agreement for the provision of electronic services.
- Personal data are processed to enable the use of Portal functions, including publishing comments, managing the profile, using Account settings and supporting functions available after login. The legal basis for processing is the performance of an agreement for the provision of electronic services.
- Personal data are processed for the purpose of providing camera broadcaster services, including adding cameras, configuring transmissions, presenting cameras in the Portal, generating thumbnails, maintaining camera availability and providing technical support. The legal basis for processing is the performance of an agreement or taking steps prior to entering into an agreement.
- Personal data are processed for the purpose of handling payments, invoices, settlements and tax obligations if the User uses paid services. The legal basis for processing is the performance of an agreement and compliance with legal obligations imposed on the Controller.
- Personal data are processed for the purpose of handling contact forms, correspondence, complaints, infringement notices, content reports and appeals against the Controller's decisions. The legal basis for processing is the performance of an agreement, compliance with legal obligations or the Controller's legitimate interest consisting in handling reports and communication with Users.
- Personal data are processed for the purpose of ensuring the security of the Portal, preventing abuse, detecting errors, protecting against unauthorised access, protecting infrastructure and maintaining technical logs. The legal basis for processing is the Controller's legitimate interest consisting in ensuring the security and proper operation of the Portal.
- Personal data are processed for the purpose of establishing, pursuing or defending against claims. The legal basis for processing is the Controller's legitimate interest consisting in the protection of its rights.
- Personal data may be processed for analytical, statistical, advertising or marketing purposes if the User has consented to the relevant cookies or similar technologies, where such consent is required by law.
§4 Cameras, image and data of persons visible in the image
- A User who adds a camera to the Portal or makes camera footage available is responsible for ensuring that such activity complies with the law, including having an appropriate legal basis for processing and publishing the image.
- A camera image may contain personal data if it enables identification of a natural person, in particular by means of appearance, distinctive features, a vehicle registration number, place of stay or other information visible in the image.
- If the User independently decides on the purpose and manner of using the camera and the image, the User may be the controller of the personal data of persons visible in the image. In such a case, the User is obliged to independently fulfil the obligations arising from the GDPR and other legal provisions.
- The Controller processes data related to cameras to the extent necessary to provide WorldCam.Live services, maintain infrastructure, ensure security, present cameras in the Portal, handle reports and implement functions selected by the User.
- The rules for adding cameras, publishing images, broadcaster responsibility and using broadcaster packages may be set out in separate Broadcaster Terms.
§5 Data recipients
- Personal data may be transferred to entities supporting the Controller in operating the Portal, in particular:
- hosting and server infrastructure providers,
- e-mail service providers,
- entities providing technical and IT support,
- entities providing accounting, legal or administrative services,
- payment operators, if payments are available in the Portal,
- Google, in connection with consent management, analytics, advertising or other Google services used in the Portal,
- public authorities or other entities authorised to obtain data under the law.
- The Controller uses Google services for consent management, analytics and advertising if such functions are active in the Portal. Use of these services may involve data processing by Google in accordance with Google's rules and the consents given by the User in the consent banner.
- The Controller does not sell Users' personal data to third parties.
- The Portal may contain links to external websites. The Controller is not responsible for the privacy practices applied by independent external websites to which such links lead.
§6 Transfers of data outside the European Economic Area
- As a rule, the Controller seeks to use services and infrastructure that process data within the European Economic Area.
- The use of Google services may involve transferring data outside the European Economic Area, in particular to countries in which Google or its subcontractors maintain technical infrastructure.
- If data are transferred outside the European Economic Area, such transfer takes place using mechanisms provided for by the GDPR, in particular an adequacy decision, standard contractual clauses or other legally permissible safeguards.
§7 Data retention period
- Data related to the Account are stored for the period during which the User uses the Account, and after its deletion for the period necessary to comply with legal obligations, handle claims, prevent abuse or ensure the security of the Portal.
- Billing, invoicing and tax data are stored for the period required by tax and accounting law.
- Data related to complaints, reports, appeals and correspondence are stored for the time needed to handle the matter and then for the limitation period for any possible claims.
- Technical logs are stored for the period necessary to ensure security, analyse errors, prevent abuse and protect infrastructure, unless longer storage is necessary due to a security incident, claim or legal obligation.
- Data related to cameras are stored for the period during which the relevant Portal function is used, and after deletion of the camera or Account for the period necessary for technical support, security, settlements, claims or compliance with legal obligations.
- Data processed on the basis of consent are processed until consent is withdrawn, unless the Controller has another legal basis for further processing.
§8 Rights of data subjects
- The data subject has the right to:
- access data,
- rectify data,
- erase data,
- restrict processing,
- data portability,
- object to processing,
- withdraw consent, if data are processed on the basis of consent,
- lodge a complaint with the President of the Personal Data Protection Office.
- Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.
- To exercise these rights, the Controller may be contacted at the e-mail address indicated in §1.
- The Controller may refuse to fulfil a request or limit its fulfilment if this results from legal provisions, the rights of other persons, the Controller's obligations, or if the request is manifestly unfounded or excessive.
§9 Deletion of Account and data
- The User may delete the Account using the function available in the profile settings or by contacting the Controller.
- Deletion of the Account results in the deletion or anonymisation of data related to the Account, unless further storage of certain data is necessary to comply with legal obligations, make settlements, handle claims, ensure Portal security, prevent abuse or protect the rights of the Controller or third parties.
- Deletion of the Account may not automatically result in deletion of data that the Controller must store under legal provisions, in particular billing, tax or complaint data, or data necessary to defend against claims.
§10 Cookies and similar technologies
- The Portal uses cookies and similar technologies to ensure the proper operation of the Portal, security, login session maintenance, remembering settings, consent management, analytics and displaying advertisements, if advertisements are active.
- Essential cookies may be used without the User's consent if they are necessary for the transmission of a communication or for providing a service requested by the User, in particular for login, session maintenance, security, remembering consent choices and proper operation of the Portal's basic functions.
- Analytical, advertising and similar Google technologies are used in accordance with the User's choice made in the Google consent banner, where consent is required by law.
- The User may manage consents at any time using the mechanism made available in the Portal and the settings of the internet browser.
- Lack of consent to analytical or advertising cookies should not prevent use of the basic functions of the Portal, but it may affect the operation of analytical, advertising or personalisation functions.
- The Portal may use first-party cookies, i.e. cookies stored by the worldcam.live domain, as well as Google cookies or similar technologies, if the User has given the required consent or if a given technology is necessary for the operation of the service.
§11 Google, analytics and advertising
- The Portal may use Google services, in particular for the consent banner, statistical measurement, analytics and displaying advertisements.
- The scope of Google services depends on the Portal settings, the configuration of Google tools and the choices made by the User in the consent banner.
- Google may process information such as cookie identifiers, IP address, device data, browser data, information about activity in the Portal and other technical data, in accordance with Google's own privacy policies and terms of service.
- The User may change consent settings concerning Google using the consent banner or the consent management mechanism available in the Portal.
§12 Data security
- The Controller applies technical and organisational measures intended to protect personal data against access by unauthorised persons, loss, alteration, destruction, unauthorised disclosure or unauthorised use.
- The measures used include, in particular, transmission encryption, access control, limiting access to data to authorised persons, server safeguards and monitoring of technical events.
- The User should protect access credentials for the Account, use a secure password and not disclose the password to third parties.
- If unauthorised access to the Account is suspected, the User should immediately change the password and contact the Controller.
§13 Infringement notices and contact
- Questions concerning personal data processing, requests to exercise rights and privacy-related reports may be sent to the e-mail address: worldcam@worldcam.pl.
- The Controller may ask the person submitting a request to provide additional information necessary to confirm identity or handle the request, if this is necessary for the protection of personal data.
- Reports concerning illegal content, infringement of third-party rights or content published in the Portal may be considered in accordance with the Portal Terms or the Broadcaster Terms.
§14 Changes to the Privacy Policy
- The Controller may amend the Privacy Policy in particular in the event of a change in legal provisions, a change in Portal functions, a change in the tools used, a change in service providers, a change in the method of data processing or the need to clarify information provided to Users.
- The Controller informs Users of material changes to the Privacy Policy by means of a notice in the Portal or by e-mail.
- The current version of the Privacy Policy is available in the Portal.
