WorldCam.Live Broadcaster Terms

§1 General provisions
- These Terms set out the rules for using camera broadcaster services in the WorldCam.Live portal, in particular the rules for adding cameras, handling transmissions or images, publishing cameras, using Packages, payments, technical support, complaints and the Broadcaster's liability.
- The Service Provider is GemsNet Mariusz Guć, with its registered office at: ul. Józefa Dwernickiego 8c/30, 85-675 Bydgoszcz, NIP: 5581728012, REGON: 093201358.
- The Service Provider may be contacted by e-mail at: worldcam@worldcam.pl.
- The Broadcaster Terms are specific terms in relation to the WorldCam.Live General Terms. Matters not regulated in these Terms are governed by the General Terms.
- If the provisions of these Terms conflict with the General Terms, these Terms prevail with respect to broadcaster services.
- Acceptance of these Terms is required before starting to use the functions for adding, handling or publishing cameras.
- The Terms are made available free of charge before the agreement is concluded and in a manner that enables them to be obtained, reproduced and stored.
§2 Definitions
- Service Provider – GemsNet Mariusz Guć, operating the WorldCam.Live portal.
- Portal or WorldCam.Live – the internet portal available at worldcam.live and related services and functions.
- Broadcaster Terms – these terms for camera broadcaster services.
- General Terms – the WorldCam.Live General Terms.
- Broadcaster – a User who adds, configures, operates or publishes a Camera in WorldCam.Live.
- Account – an individual User account in WorldCam.Live, enabling use of functions available after login.
- Camera – a device, image source, stream, URL address, image file or other configuration enabling an image or transmission to be made available in WorldCam.Live.
- Image – a still image, image snapshot, thumbnail, preview, video stream or other visual material originating from a Camera.
- Broadcaster Content – data, descriptions, names, locations, configurations, Image, links, image snapshots, thumbnails and other content submitted, added or made available by the Broadcaster in connection with a Camera.
- Broadcaster Service – a digital service consisting in enabling the Broadcaster to add a Camera, configure its operation, publish the Image and use the functions available in the selected Package.
- Package – a variant of the Broadcaster Service defining the scope of functions, technical limitations, duration, publication terms, technical support or price.
- Price List – information on current prices, billing periods and Package functions, available in the Portal before ordering a paid Package.
- Professional User – an entrepreneur, legal person, organisational unit, institution, administrative authority, organisation or other entity using the Broadcaster Service in connection with its business, professional, statutory, public or official activity.
- Illegal Content – content that is unlawful under European Union law or Polish law, in particular content infringing personal rights, copyright, image rights, privacy, personal data protection regulations, criminal law provisions or third-party rights.
§3 Nature of the Broadcaster Service
- The Broadcaster Service consists in providing functions that enable adding a Camera, configuring its parameters, handling the Image and publishing the Camera in WorldCam.Live in accordance with the selected Package.
- The scope of the Broadcaster Service depends on the selected Package, its description, Account settings and the current functions available in the Portal.
- The Broadcaster Service may be provided in free or paid Packages.
- Mere possession of an Account in WorldCam.Live does not mean ordering a paid Package.
- The Service Provider may change, develop or remove individual functions of the Broadcaster Service, provided this does not infringe the Broadcaster's acquired rights arising from a paid Package or mandatory provisions of law.
§4 Technical requirements
- Use of the Broadcaster Service requires:
- an Account in WorldCam.Live,
- a device with internet access,
- an up-to-date internet browser supporting HTML5, JavaScript and encrypted SSL/TLS connections,
- an active e-mail account,
- a Camera or image source compliant with the technical requirements of the Broadcaster Service,
- a stable internet connection on the Broadcaster's side.
- The Camera should provide a video stream or image in a format supported by WorldCam.Live, in particular RTSP or JPG, unless the Package description or technical instructions indicate other requirements.
- The Service Provider may update the technical requirements if this is justified by technological development, changes in security, changes in browsers, changes in infrastructure or the need to ensure proper operation of the Broadcaster Service.
- The Broadcaster is responsible for the proper operation of its own Camera, internet connection, network configuration, power supply, safeguards and equipment, unless the malfunction results from reasons attributable to the Service Provider.
§5 Conclusion of the agreement and activation of the Broadcaster Service
- The agreement for using a free Broadcaster Service Package is concluded when the Broadcaster Terms are accepted and the User starts using the functions for adding or handling a Camera.
- The agreement for using a paid Package is concluded when an order is placed, the Broadcaster Terms are accepted, the order is confirmed and payment is effectively made, unless the Package description provides otherwise.
- Before ordering a paid Package, the Broadcaster receives information on the main features of the Package, the price, billing period, service duration, payment method and rules for ending use of the Package.
- The Service Provider may refuse to activate the Broadcaster Service or remove a Camera if the Camera configuration, Broadcaster Content or manner of using the Service infringes the law, the General Terms, these Terms, third-party rights or Portal security.
§6 Paid Packages only for Professional Users
- Paid Packages of the Broadcaster Service are available only to Professional Users.
- The Service Provider does not offer paid Packages to consumers, i.e. natural persons entering into an agreement not directly related to their business or professional activity.
- A person placing an order for a paid Package declares that they enter into the agreement as a Professional User or on behalf of a Professional User whom they are authorised to represent.
- A natural person conducting business activity, when placing an order for a paid Package, declares that the agreement is concluded directly in connection with that person's business activity and is of a professional nature for that person, resulting in particular from the subject of the activity, the manner of using the Broadcaster Service or the purpose for which the Package is ordered.
- The Service Provider may request company, institution or organisation data, in particular name, address, tax identification number or other identifier, invoice data and contact person details.
- The Service Provider may refuse to activate a paid Package, cancel an order or request additional information if it has justified doubts as to whether the order was placed by a Professional User.
- Private individuals may use only free Broadcaster Service Packages, provided they are currently offered by the Service Provider and provided they meet the conditions specified in the Terms.
§7 Rules for using the Broadcaster Service
- The Broadcaster is obliged to use the Broadcaster Service in accordance with the law, the General Terms, these Terms, good practice, principles of social coexistence and the intended purpose of the Service.
- The Broadcaster is responsible for Broadcaster Content, including the Image originating from the Camera, the Camera description, the indicated location and the manner of configuring publication.
- The Broadcaster declares that they have the right to use the Camera, image source, infrastructure, connection and Broadcaster Content to the extent necessary to use the Broadcaster Service.
- It is prohibited to add, publish or transmit through the Broadcaster Service any content that:
- constitutes Illegal Content,
- infringes third-party rights, including the right to privacy, personal rights, copyright, image rights or personal data protection regulations,
- shows places where third parties may reasonably expect privacy,
- discloses confidential information, access data, documents, correspondence or other data that the Broadcaster has no right to make available,
- infringes the security of the Portal or the Service Provider's infrastructure,
- is inconsistent with the subject matter, nature or intended purpose of WorldCam.Live.
- The Broadcaster should configure the Camera in a manner that limits the risk of infringing the privacy and rights of third parties.
- The Broadcaster should secure the Camera, devices, passwords, stream addresses and access data against access by unauthorised persons.
- If unauthorised access to the Camera, Account or stream is suspected, the Broadcaster should immediately change access data and contact the Service Provider.
§8 Image publication and licence
- If the Broadcaster enables public visibility of the Camera or uses a Package providing for publication of the Camera, the Broadcaster consents to public availability of the Image and Broadcaster Content in WorldCam.Live in accordance with the Account settings and the scope of the selected Package.
- The Broadcaster grants the Service Provider a non-exclusive, royalty-free, territorially unlimited licence to use Broadcaster Content to the extent necessary to provide the Broadcaster Service, operate the Portal, present the Camera, create thumbnails, maintain the camera catalogue functions and technically handle the transmission or image.
- The licence includes, in particular, fixation, reproduction, storage, display, public sharing, transmission, technical adaptation and presentation of Broadcaster Content in the Portal.
- The licence remains in force for the period during which the Broadcaster uses the Camera publication functions, subject to technical copies, logs, security archives and data that the Service Provider may store under the law, the Terms or the Privacy Policy.
- If a given Package allows publication of the Camera in the WorldCam.Live catalogue to be disabled, the Broadcaster may manage Camera visibility in the Account settings.
- If public visibility of the Camera is a function of a given Package, information about this should be available to the Broadcaster before selecting the Package.
- Embedding or presenting the Camera outside the main WorldCam.Live pages is permitted if this results from Portal functions, Account settings, the Package description or separate arrangements with the Broadcaster.
§9 Moderation, reports and Camera restriction
- The procedure set out in the General Terms applies to reporting Illegal Content, infringements of third-party rights and appeals against Service Provider decisions.
- The Service Provider may remove a Camera, restrict its visibility, block a transmission, remove Broadcaster Content, suspend Broadcaster functions or suspend the Account if:
- the Camera, Image or Broadcaster Content infringes the law, the General Terms, these Terms or third-party rights,
- an infringement report proves justified,
- operation of the Camera threatens the security of the Portal, infrastructure or other Users,
- the Broadcaster uses the Broadcaster Service contrary to its intended purpose,
- the Broadcaster is not authorised to use the Camera, stream or Broadcaster Content.
- In cases requiring an immediate response, the Service Provider may take action without prior notice to the Broadcaster.
- The scope of the restriction should be adequate to the type and scale of the infringement.
§10 Fees, payments and invoices
- For using a paid Package, the Broadcaster pays remuneration in accordance with the Price List in force at the time of placing the order.
- The Service in a paid Package is paid in advance for the selected billing period, unless the Package description provides otherwise.
- After the paid billing period ends, the Broadcaster Service may be restricted, blocked or switched to a free Package, if such a Package is available.
- The Broadcaster may pay for the Broadcaster Service for the next billing period if the given Package is still offered by the Service Provider.
- The Service Provider may change the Price List. A change in the Price List does not affect an already paid billing period, unless the change is beneficial to the Broadcaster.
- A Broadcaster using a paid Package agrees to invoices being issued and sent electronically to the e-mail address assigned to the Account or indicated in the billing data.
- The Broadcaster is obliged to provide correct and up-to-date billing data.
§11 Technical support
- The Broadcaster has the right to use technical support regarding the operation of the Broadcaster Service.
- Technical reports should be submitted through the contact form available in the Account or to the e-mail address: worldcam@worldcam.pl.
- Technical support is provided from Monday to Friday between 9:00 and 17:00, excluding statutory public holidays, unless the Package description provides otherwise.
- Technical support covers problems related to the operation of the Broadcaster Service on the Service Provider's side.
- Reports concerning the configuration of the Broadcaster's equipment, the Broadcaster's network, external devices, cameras, routers, internet providers or external services may be considered where possible, but they do not constitute the basic scope of support, unless the Package description provides otherwise.
- The Service Provider may offer additional technical assistance outside the standard scope of support for a separately agreed fee.
§12 Availability of the Broadcaster Service and technical breaks
- The Service Provider makes efforts to ensure that the Broadcaster Service operates properly and, as far as possible, without interruptions.
- The Service Provider may temporarily restrict or interrupt the operation of the Broadcaster Service in order to carry out technical work, updates, maintenance, fault repairs, security improvements or abuse prevention.
- The Service Provider informs Broadcasters of planned technical breaks with appropriate advance notice if this is possible and justified by the nature of the work.
- The Broadcaster Service may depend on the operation of the internet, the Broadcaster's infrastructure, the Broadcaster's devices, hosting providers, telecommunications operators or other technical services. The Service Provider is not responsible for irregularities resulting exclusively from reasons beyond the Service Provider's control, unless mandatory provisions of law provide otherwise.
§13 Termination of the agreement and deletion of Cameras
- The Broadcaster may at any time delete a Camera from the Account or stop using the Broadcaster Service.
- Deletion of the Account is equivalent to termination of the agreement for provision of the Broadcaster Service, subject to the effects concerning paid Packages, billing data, claims and legal obligations.
- The Service Provider may terminate the agreement for provision of the Broadcaster Service with 30 days' notice in the event of discontinuation of the Broadcaster Service, a material technological change, cessation of business activity or another important reason indicated to the Broadcaster.
- If the Service Provider terminates the agreement for reasons not attributable to the Broadcaster, a Broadcaster using a paid Package will receive a refund for the unused billing period.
- The Service Provider may terminate the agreement with immediate effect, remove a Camera or block the Account if the Broadcaster grossly infringes the General Terms, these Terms, legal provisions, third-party rights or Portal security.
- After the paid billing period ends and payment for the next period is not made, the Service Provider may restrict or block paid functions of the Broadcaster Service.
- The Service Provider may delete data related to an inactive or blocked Camera after 90 days from the date of blocking or termination of the Broadcaster Service, unless legal provisions, settlements, security or claims justify longer storage of data.
§14 Complaints concerning the Broadcaster Service
- The Broadcaster may submit a complaint concerning the operation of the Broadcaster Service to the e-mail address: worldcam@worldcam.pl.
- The complaint should include data enabling identification of the Broadcaster, Account or Camera, a description of the problem, the date on which the problem occurred and the expected manner of handling the complaint.
- Lack of some information does not deprive the Broadcaster of the right to submit a complaint, but it may make its consideration more difficult or take longer.
- The Service Provider considers the complaint within 14 days from the date of receipt.
- The response to the complaint is sent to the Broadcaster's e-mail address or another address indicated in the complaint.
§15 Personal data
- The rules for processing personal data by the Service Provider, using cookies and similar technologies, and the rights of data subjects are set out in the Privacy Policy.
- The Broadcaster is responsible for the lawfulness of processing and making available personal data visible in the Image if the Broadcaster decides on the purpose and manner of using the Camera and publishing the Image.
- If the Camera Image includes natural persons, private places, vehicle registration numbers, property markings or other information that may lead to identification of persons, the Broadcaster should assess whether they have an appropriate legal basis for such processing and publication.
- The Broadcaster should avoid publishing the Image in a manner that infringes the privacy of third parties or leads to disclosure of data that the Broadcaster has no right to make available.
§16 Liability
- The Broadcaster is responsible for Broadcaster Content, the Image, Camera configuration and compliance of use of the Broadcaster Service with the law.
- The Service Provider is responsible for proper provision of the Broadcaster Service to the extent resulting from the Terms, the selected Package and mandatory provisions of law.
- In the case of Broadcasters who are neither consumers nor entrepreneurs with consumer rights, the Service Provider's liability for lost profits is excluded, unless the damage was caused intentionally.
- In the case of Broadcasters who are neither consumers nor entrepreneurs with consumer rights, the Service Provider's total liability for damages related to a paid Package is limited to the amount of fees paid by the Broadcaster for the last 3 months of using the given Package, unless the damage was caused intentionally and unless mandatory provisions of law provide otherwise.
- No provision of the Terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of law.
§17 Changes to the Broadcaster Terms
- The Service Provider may amend the Broadcaster Terms for important reasons, in particular in the event of:
- a change in legal provisions,
- a change in the functions of the Broadcaster Service,
- a change in Packages or the manner in which they are provided,
- a technological change,
- the need to increase Portal security,
- the need to prevent abuse,
- the need to clarify the Terms or adapt them to the current manner of operation of the Broadcaster Service.
- The Service Provider informs Broadcasters of a change to the Broadcaster Terms by means of a notice in the Account or an e-mail at least 14 days before the changes enter into force, unless the change is purely technical, organisational, beneficial to the Broadcaster or results from an urgent need to ensure security or comply with a legal obligation.
- A Broadcaster who does not accept changes to the Broadcaster Terms may stop using the Broadcaster Service before the date on which the changes enter into force.
- If a change to the Broadcaster Terms affects the rights or obligations of a Broadcaster using a paid Package and the Broadcaster does not accept the change, the Broadcaster is entitled to a refund for the unused billing period, unless the change results from a legal obligation or is necessary for security reasons.
§18 Final provisions
- The law applicable to the agreement for provision of the Broadcaster Service is Polish law.
- In the case of Broadcasters who are consumers, disputes are resolved by the court having jurisdiction in accordance with mandatory provisions of law.
- In the case of Broadcasters who are neither consumers nor entrepreneurs with consumer rights, disputes may be resolved by the court having jurisdiction over the Service Provider's registered office.
- No provision of the Terms excludes or limits the rights of a consumer or an entrepreneur with consumer rights arising from mandatory provisions of law.
- In matters not regulated by the Broadcaster Terms, the General Terms and provisions of Polish law apply.
- In the event of discrepancies between language versions of the Broadcaster Terms, the Polish version is binding.
