WorldCam.Live General Terms

§1 General provisions

  1. These Terms set out the general rules for using the WorldCam.Live portal, available at worldcam.live, in particular the rules for Account registration, using Portal functions, publishing content, reporting infringements, and the rights and obligations of Users and the Administrator.
  2. The Administrator of the Portal is GemsNet Mariusz Guć, with its registered office at: ul. Józefa Dwernickiego 8c/30, 85-675 Bydgoszcz, NIP: 5581728012, REGON: 093201358.
  3. The Administrator may be contacted by e-mail at: worldcam@worldcam.pl.
  4. The Terms are made available free of charge before conclusion of the agreement for the provision of electronic services and in a manner that enables them to be obtained, reproduced and stored.
  5. Acceptance of the Terms is equivalent to concluding an agreement for the provision of electronic services within the scope of Portal functions available to a registered User.
  6. Account registration in the Portal is free of charge and does not oblige the User to incur any fees. Mere possession of a basic Account does not involve an obligation to pay.
  7. Selected additional services, in particular services intended for camera broadcasters, may be paid if this follows from the relevant price list, service description or separate terms.
  8. The conditions for adding, handling and publishing cameras are set out in the Broadcaster Terms. If the User uses camera broadcaster functions, the Broadcaster Terms apply in addition to these Terms.
  9. In the event of a conflict between these Terms and the Broadcaster Terms, the Broadcaster Terms prevail with respect to broadcaster services.

§2 Definitions

  1. Administrator – GemsNet Mariusz Guć, operating the WorldCam.Live portal.
  2. Portal or WorldCam.Live – the internet portal available at worldcam.live and related services and functions made available by the Administrator.
  3. Terms – these WorldCam.Live General Terms.
  4. User – a natural person, legal person or organisational unit without legal personality that uses the Portal or has an Account.
  5. Account – an individual User panel in the Portal, available after login.
  6. Login – an individual User identifier used to access the Account.
  7. Password – a string of characters established by the User to secure access to the Account.
  8. User Content – any content, data, comments, descriptions, names, links, materials, configurations or other information published, transmitted or made available by the User in the Portal.
  9. Illegal Content – content that is unlawful under European Union law or Polish law, in particular content infringing personal rights, copyright, image rights, privacy, personal data protection regulations, criminal law provisions or third-party rights.
  10. Broadcaster Terms – separate terms setting out the rules for using the functions for adding, handling and publishing cameras in WorldCam.Live.
  11. Privacy Policy – the document describing the rules for processing personal data, cookies and similar technologies in the Portal.

§3 Types and scope of services

  1. The Administrator provides electronic services consisting in particular in:
    1. enabling registration and maintenance of an Account,
    2. enabling use of functions available after login,
    3. enabling browsing of content available in the Portal,
    4. enabling publication of comments or other User Content, if such a function is available,
    5. enabling contact with the Administrator,
    6. enabling reporting of content that infringes the law, the Terms or third-party rights,
    7. making camera broadcaster functions available on the terms set out in the Broadcaster Terms.
  2. The scope of Portal functions may vary depending on whether the User uses the Portal without logging in, has an Account, uses broadcaster functions or uses additional services.
  3. The Administrator may develop, change, add, restrict or remove Portal functions, provided this does not infringe the User's acquired rights arising from a concluded agreement or mandatory provisions of law.

§4 Technical requirements

  1. Use of the Portal requires:
    1. a device with internet access,
    2. an up-to-date internet browser supporting HTML5, JavaScript and encrypted SSL/TLS connections,
    3. an active e-mail account, if the User wishes to register an Account,
    4. enabling cookies necessary for the proper operation of the Account and the basic functions of the Portal.
  2. Use of outdated software, an unusual browser configuration, script blockers or cookie blockers may prevent use of some Portal functions.
  3. The User is responsible for ensuring, on the User's side, the device, internet connection, software and technical configuration enabling use of the Portal.

§5 Registration and Account

  1. Account registration is voluntary and free of charge.
  2. The User is obliged to provide true, up-to-date and lawful data during registration.
  3. The User should protect the Password and Account access data against access by unauthorised persons.
  4. The User should not make the Account available to third parties, unless acting on behalf of an entity authorised to use the Account.
  5. The User is responsible for actions performed using the User's Account, unless those actions occurred for reasons attributable to the Administrator or despite the User exercising due care.
  6. If unauthorised access to the Account is suspected, the User should immediately change the Password and contact the Administrator.
  7. The User may delete the Account at any time using the function available in the profile settings or by contacting the Administrator.

§6 Rules for using the Portal

  1. The User is obliged to use the Portal in accordance with the law, the Terms, good practice, principles of social coexistence and the intended purpose of the Portal.
  2. In particular, it is prohibited to:
    1. provide or publish Illegal Content,
    2. infringe third-party rights, including personal rights, copyright, image rights, privacy or personal data protection,
    3. take actions that disrupt the operation of the Portal,
    4. attempt to obtain unauthorised access to Accounts, data, systems or the Administrator's infrastructure,
    5. use the Portal to transmit spam, malware, phishing content or other content that infringes security,
    6. impersonate other persons or entities,
    7. automatically download data from the Portal in a manner that disrupts its operation or infringes the rights of the Administrator or third parties.
  3. The User is responsible for User Content that the User publishes, transmits or makes available in the Portal.
  4. The Administrator has no general obligation to monitor User Content, but may take actions aimed at detecting, identifying, restricting or removing infringements of law, the Terms or Portal security.
  5. The Administrator may remove, restrict visibility of, block or modify the manner of presenting User Content if justified by an infringement of the law, the Terms, the Broadcaster Terms, third-party rights, Portal security or a report received.

§7 Reporting Illegal Content and infringements

  1. The Administrator designates the following point of contact for reports concerning Illegal Content and infringements: worldcam@worldcam.pl.
  2. A report should include:
    1. identification of the content, camera, comment, profile or other element to which the report relates,
    2. the URL address or other data enabling identification of the reported content,
    3. an explanation of the reasons for considering the content illegal or infringing a third party's rights,
    4. the reporting person's contact details, unless the report concerns information for which legal provisions allow reporting without providing data,
    5. a statement that the report is made in good faith and that the information provided is correct and complete to the reporting person's knowledge.
  3. The Administrator confirms receipt of the report if the reporting person provided contact details.
  4. The Administrator considers reports without undue delay, objectively and with due care.
  5. After considering the report, the Administrator may in particular:
    1. leave the content unchanged,
    2. restrict the visibility of the content,
    3. remove the content,
    4. block a specific function,
    5. suspend or delete an Account,
    6. take other actions required or permitted by law.
  6. If the Administrator decides to restrict content or an Account due to an infringement of law or the Terms, the Administrator provides the User with reasons for the decision, insofar as this is required by law and possible in the circumstances.
  7. A User whose content or Account has been restricted may submit an appeal to the e-mail address: worldcam@worldcam.pl within 14 days of receiving information about the decision.
  8. Abuse of the reporting procedure, in particular repeated reporting of manifestly unfounded infringements, may result in restriction of the ability to submit reports, where permitted by law.

§8 Restriction, suspension or deletion of the Account

  1. The Administrator may temporarily restrict Account functions, suspend the Account or delete the Account if the User:
    1. infringes the Terms, the Broadcaster Terms or legal provisions,
    2. publishes Illegal Content,
    3. infringes third-party rights,
    4. takes actions threatening Portal security,
    5. uses the Portal contrary to its intended purpose,
    6. provides false or misleading data, if this is relevant to use of the Portal.
  2. The scope of the restriction should be adequate to the type and scale of the infringement.
  3. In cases requiring an immediate response, in particular for security reasons or due to an obvious breach of the law, the Administrator may take action without prior notice to the User.
  4. Deletion of the Account by the User or the Administrator results in termination of the agreement for the provision of electronic services within the scope of the Account, subject to further storage of data in the cases described in the Privacy Policy or required by law.

§9 Availability of the Portal and technical breaks

  1. The Administrator makes efforts to ensure that the Portal operates properly and, as far as possible, without interruptions.
  2. The Administrator may temporarily restrict access to the Portal or its functions in order to carry out technical work, maintenance, updates, fault repairs, security improvements or abuse prevention.
  3. The Administrator informs about planned technical breaks in the Portal if this is possible and justified by the nature of the work.
  4. The Administrator is not responsible for interruptions or irregularities resulting from reasons beyond the Administrator's control, in particular failures of the internet, telecommunications infrastructure, force majeure events, actions of public authorities or attacks on infrastructure, unless mandatory provisions of law provide otherwise.

§10 Complaints

  1. The User may submit a complaint concerning the operation of the Portal to the e-mail address: worldcam@worldcam.pl.
  2. The complaint should include data enabling identification of the User or Account, a description of the problem, the date on which the problem occurred and the expected manner of handling the complaint.
  3. Lack of some information does not deprive the User of the right to submit a complaint, but it may make its consideration more difficult or take longer.
  4. The Administrator considers the complaint within 14 days from the date of receipt.
  5. The response to the complaint is sent to the User's e-mail address or another address indicated in the complaint.

§11 Personal data and cookies

  1. The rules for processing personal data, using cookies and similar technologies, and the rights of data subjects are set out in the Privacy Policy.

§12 Changes to the Terms

  1. The Administrator may amend the Terms for important reasons, in particular in the event of:
    1. a change in legal provisions,
    2. a change in Portal functions,
    3. a change in the manner of operation of the Account,
    4. a technological change,
    5. the need to increase Portal security,
    6. the need to prevent abuse,
    7. the need to clarify the Terms or adapt them to the current manner of operation of the Portal.
  2. The Administrator informs registered Users of a change to the Terms by means of a notice in the Account or an e-mail at least 14 days before the changes enter into force, unless the change is purely technical, organisational, beneficial to the User or results from an urgent need to ensure security or comply with a legal obligation.
  3. A User who does not accept changes to the Terms may delete the Account before the date on which the changes enter into force, which results in termination of the agreement for the provision of electronic services.
  4. Changes to the Terms do not affect the User's acquired rights before the changes enter into force, unless mandatory provisions of law provide otherwise.

§13 Final provisions

  1. The law applicable to the agreement for the provision of electronic services is Polish law.
  2. In the case of Users who are consumers, disputes are resolved by the court having jurisdiction in accordance with mandatory provisions of law.
  3. In the case of Users who are neither consumers nor entrepreneurs with consumer rights, disputes may be resolved by the court having jurisdiction over the Administrator's registered office.
  4. No provision of the Terms excludes or limits the rights of a consumer or an entrepreneur with consumer rights arising from mandatory provisions of law.
  5. In matters not regulated by the Terms, provisions of Polish law apply.
  6. In the event of discrepancies between language versions of the Terms, the Polish version is binding.
